Privacy and Credit Reporting Policy

 

Camnet and its related bodies corporate are dedicated to protecting your personal information and sensitive information including credit information and credit eligibility information that you provide us with in accordance with this Privacy Policy and or a signed Privacy consent you have given us in the course of us providing you with our services. In collecting, holding, using and otherwise managing your personal information Camnet will comply with the Privacy Act 1988 (Cth) (Privacy Act) and the 13 Australian Privacy Principles set out in that Act and to the extent that information relates to credit related personal information Camnet will also comply with the Credit Reporting Code. 

In this Policy a reference to Camnet is a reference (as applicable) to:

  • Camnet Pty Ltd (ACN 051 204 472);

  • Camnet Finance Pty Ltd (ACN 129 689 130); or

  • Camnet Australia Pty Ltd (ACN 074 276 690).


About Us 

Camnet supplies office automation equipment and related services as well as IT products and related services to business. We also provide equipment finance through Camnet Finance Pty Ltd in its own right, or, acting as an agent. 

 This policy sets out how Camnet aims to protect the privacy of your personal information, your rights in relation to that personal information, and the way Camnet collects, holds, uses, discloses, and otherwise manages your credit related personal information. This policy may be updated from time to time and provide further information in relation to the types of Personal Information including Credit Information and Credit Eligibility Information we may collect, our handling of Personal Information, how you may access and request the correction of Personal Information we hold about you, how you may make a complaint and our complaint handling procedures. Our policy as amended from time to time is available to view at www.camnet.com.au or on request. 


Kind of Personal Information Collected 

For the purposes of the Privacy Act, “Personal Information” is information or an opinion about an identified or reasonably identifiable individual and, for the purposes of this policy includes various types of credit related personal information. 

The type of information that we collect from you will depend on what products and services you require from Camnet. We may obtain your personal information through our website, by email, by telephone, by written responses or through personal visits by our staff. In a few instances on our website, we ask you to provide information that personally identifies you or allows us to contact you. This information enables us to assist you with technical support issues, to respond to product enquiries, assist us in assessing or sourcing for you or for a company of which you are a director credit for business purposes or to asses an application by you to be a guarantor, or to enable you to download any information from our website, to enable you to subscribe to Camnet News or to follow up with you after an enquiry or visit by you. On some occasions Camnet may collect personal information from other sources such as a broker, accountant, lawyer or other third party acting on your behalf or a credit reporting body after obtaining your written consent to collecting information from such sources.  

Generally, the information we ask you to provide is restricted to your name, your telephone number, your company name and address, and your email address. Where we will be providing credit we may ask you for credit information as defined in the Privacy Act relevant to assessing an application for commercial credit or your offer to be a guarantor of commercial credit. This information includes identification information, consumer credit liability information including information about your credit providers and accounts, whether or not you have not met any repayment obligations or defaulted on a payment obligation, that another credit provider has sought credit related information about you, information about the types of commercial and or consumer credit and the amounts of credit you have sought from a credit provider, information about court actions related to credit provided to you or for which you have applied, personal insolvency information and other publicly available information related to your credit worthiness, including a credit provider’s reasonable belief that you have committed a serious credit infringement, and any other information we may lawfully obtain within the credit reporting system or from a credit reporting body. It is optional for you to provide us with your personal information, but without it we may be unable to assist you with any relevant request. 


Cookies 

Camnet also makes limited use of cookies on its website. We only use cookies to improve the functionality of our website not to store any of your personal information. When cookies are used on our website, they are used to store information relating to your visit such as a unique identifier or a value to indicate whether you have seen a web page and to distinguish your internet browser from the thousands of other browsers. The cookies help us to develop the design and layout of the website, improve applications and measure the effectiveness of our marketing activities. If you do not wish to receive cookies, you may be able to change the settings of your browser to refuse all cookies or notify you each time a cookie is sent to your computer, giving you the choice whether to accept it or not. 


Purposes for which personal information is collected held used and disclosed. 

Camnet collects, holds, uses and discloses personal information where it is reasonably necessary for Camnet’s purposes to:

  • verify your identity;

  • assess a commercial credit application you make to us, or to assess a credit application made by a company of which you are a director, or to assess your capacity including your financial capacity to act as a guarantor;

  • source any finance you may require;

  • manage your agreement with us and your accounts in relation to credit provided, including maintaining the value of and protecting any assets being security in connection with credit provided;

  • collect payments that are overdue to us including in relation to commercial credit provided by us;

  • notify other credit providers of any default by you with us;

  • comply with laws which may require or authorise us to obtain information about you such as the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth), the Personal Property and Securities Act 2009 (Cth) or as the law otherwise authorises or requires;

  • answer any queries you make;

  • Provide credit information about you to a guarantor or prospective guarantor;

  • Disclose your personal or credit information to the extent permitted by law to other organisations that provide us with services such as contractors, agents, printers, mail houses,
    lawyers, collection agencies, document custodians, securitisers and computer systems consultants or providers so that they can perform those services for us;

  • Disclose your personal information to any other organisation that may wish to acquire or has acquired an interest in our business or any rights under your contract with us or
    the contract with us of a company of which you are a director;

  • obtain from a credit reporting body (CRB), on one or more than one occasion, information about you in relation to consumer or commercial credit provided to you (or another person or entity) where applicable for the purpose of:

  • assessing your application for consumer or commercial credit, or the application of a company of which you are a director;

  • assessing whether to accept you to act as a guarantor; and

any other purpose expressly disclosed under this policy or in relation to which we have received a signed consent from you. 

Disclosure of Personal Information 

Camnet discloses your personal information for the purposes for which it collects it. This may include disclosure to third parties engaged by us to perform administrative or other management functions of our business, a principal for whom we are acting as agent, debt collection or other similar service providers for recovery and collection purposes, people or entities considering acquiring an interest in Camnet, our finance contracts or other assets, our professional advisors and other service providers to Camnet from time to time, such as our administration, technology, and auditing service providers.  Camnet does not otherwise give or share any personally identifiable information with third parties but may also disclose your personal information including credit information to other credit providers or a credit reporting body. 

The credit reporting body that we currently exchange Personal Information with is Equifax Pty Ltd, 100 Arthur Street North Sydney, NSW 2060. A copy of its privacy policy which sets out how it manages credit related and personal information can be obtained on its website at www.equifax.com.au.


Direct marketing 

Camnet may use and disclose your personal information in order to inform you of other products and services which may be of interest to you. This may include Camnet disclosing your personal information to the related bodies corporate described in this policy for the purpose of that entity contacting you regarding offers or information about the products or services of that entity. If you do not wish to receive such information you can opt out by contacting our Privacy Officer on (02) 8252 6000 or emailing our Privacy Officer at privacyofficer@camnet.com.au.

 

Overseas Disclosures

Camnet is not likely to disclose any personal information to overseas recipients. However, where it is necessary to make any overseas disclosures in order to provide our services or for related business or operational purposes Camnet will take all reasonable steps to ensure the overseas recipient complies with the Australian Privacy Principles or is bound by a substantially similar privacy scheme unless the disclosure is otherwise permitted by law or you have expressly consented to that overseas disclosure. 


Security of Personal Information 

Camnet takes all reasonable steps available in the circumstances to ensure that the personal information it holds is protected from misuse, interference or loss from unauthorised access, modification, or disclosure. 

All stored personal information is retained on a secure server and is protected from unauthorised access through the use of fire-walls, secure passwords, user logins or other security procedures. However, we emphasise that the internet is not a secure environment and counsel you to please be careful and responsible when online. If you post personal information online it may be accessible to the public, and you may receive unsolicited messages from other parties. While Camnet strives to protect your personal information, Camnet cannot ensure or warrant the security of any information you choose to transmit to us via the internet. 

We will destroy or de-identify personal information that you provide to us where it is no longer required for the purpose for which it was collected where we are not otherwise required to retain that information for a longer period by law.


Access and correction

Camnet takes reasonable steps in the circumstances to ensure personal information it holds is accurate, up to date, relevant, complete and not misleading. 

Under the Privacy Act you have the right to seek access to personal information collected and held by us for verification or correction of your personal information.  If you would like to access or correct the personal information Camnet holds about you please contact our Privacy Officer on (02) 8252 6000.

Camnet will provide access to the extent authorised and required by the Privacy Act and will take reasonable steps to correct personal information where necessary and appropriate. Where necessary to correct credit related personal information, Camnet may consult with Equifax and or another credit reporting body. 

To obtain access to your personal information you will need to provide details of the information you require and proof of your identity. Camnet may charge a reasonable administration fee to recover the cost of retrieval and dealing with your request for access. 

Camnet will respond to any request for access within a reasonable time. If we refuse a request for access or a request to correct your personal information, we will provide you with written reasons for the refusal. If you are not happy with a refusal to any request to provide access or change personal information held by us you may make a complaint to us in writing to the attention of The Privacy Officer Camnet, Unit 1 5-15 Epsom Road Roseberry NSW 2018 or to privacyofficer@camnet.com.au who will review your complaint and respond within 30 days. If you are unhappy with our response you may make a complaint to the Office of the Australian Information Commissioner.
